AaBC123 Framework™ Resource Terms of Use

1. About these Terms
These Terms govern your access to and use of the AaBC123 Framework™ resources made available through this website, including downloadable documents, diagrams, templates, graphics, videos, written explanations and related materials (“Resources”).
These Terms form an agreement between you, Katie Ashburner and Toowoomba Positive Psychology Pty Ltd (“we”, “us” or “our”, as applicable).
By selecting the agreement checkbox, accessing or downloading the Resources, you confirm that you have read and agree to these Terms. If you are using the Resources on behalf of an organisation, you confirm that you have authority to accept these Terms on its behalf.
2. Our intention
The AaBC123 Framework™ is intended to make evidence-informed wellbeing knowledge practical and accessible.
We encourage appropriate use of the Framework for learning, teaching, research, professional development, organisational practice and the delivery of broader professional services.
Making the Resources accessible does not transfer ownership or grant an unrestricted right to reproduce, commercialise, modify, rebrand or redistribute them.
3. Intellectual property ownership
Unless otherwise identified:
copyright in the original written, visual, recorded and downloadable AaBC123 Framework™ Resources is owned by Katie Ashburner;
the AaBC123 Framework™ name, associated logos and branding are used as trade marks and are controlled by Toowoomba Positive Psychology Pty Ltd; and
third-party content remains the property of its respective copyright or intellectual property owner.
All rights not expressly granted under these Terms are reserved.
The ™ symbol identifies a name or logo being used as a trade mark. It does not represent that the trade mark is registered.
4. Permission granted to you
Subject to these Terms, Katie Ashburner grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable permission to:
access and download the Resources for your own legitimate use;
use the Resources for learning, teaching, research and professional development;
apply the AaBC123 Framework™ concepts within your classroom, professional practice, research activities, team or organisation;
refer to and apply the Framework while providing broader professional services, including education, coaching, consulting and wellbeing services, whether you are salaried or charge for those broader services;
display an unmodified Resource during a classroom lesson, client session, internal workshop, team meeting or similar activity; and
make a reasonable number of printed copies for participants in such an activity, provided the Resource remains unmodified, includes its copyright and attribution information, and is not separately sold or charged for.
Your use must be consistent with the purpose and integrity of the Framework and must not imply that you or your organisation developed, own, endorse, certify or officially represent the AaBC123 Framework™.
5. What this permission does not allow
Unless you have received prior written permission, you must not:
sell, license, sublicense, hire out or commercially distribute the Resources;
forward downloadable files to others or upload them to a public website, shared resource library, social media platform, commercial platform or publicly accessible drive;
incorporate a Resource, or a substantial part of one, into a product, course, program, training package, manual, application, membership, subscription or resource collection that is sold or commercially supplied;
advertise, promote or deliver an AaBC123 Framework™ course, certification, accreditation, facilitator training, train-the-trainer program or branded service;
represent the AaBC123 Framework™ as your own framework, model, methodology or intellectual property;
remove or obscure copyright, trade mark, attribution or other ownership notices;
modify, translate, rebrand, reproduce or create derivative versions of the Resources and present them as authorised or official AaBC123 Framework™ materials;
use the AaBC123 Framework™ name, logo or branding in a business name, domain name, social-media identity, product name, program name or marketing campaign;
use the Resources as training data for an artificial-intelligence or machine-learning model or dataset; or
use the Resources unlawfully, misleadingly or in a way that may damage the integrity or reputation of the AaBC123 Framework™.
If another person would like their own copy of a Resource, please direct them to the official AaBC123 Framework™ website rather than forwarding the downloaded file.
6. Professional and paid practice
These Terms do not prevent a teacher, practitioner, researcher, consultant, coach or other professional from applying the Framework as one part of their ordinary work.
Receiving a salary or charging for a broader professional service does not, by itself, constitute prohibited commercial use.
However, you may not charge specifically for access to the AaBC123 Resources, market the Framework as your own offering, or make AaBC123-branded materials, training or certification a product you sell without prior written permission.
If you are uncertain whether a proposed use falls within this permission, please contact us before proceeding.
7. Attribution
Whenever you reproduce a permitted extract, display a Resource or publicly refer to the Framework, you must provide clear and reasonable attribution.
Unless a Resource specifies a different citation, the following wording may be used:

Academic and research publications should also cite the relevant AaBC123 publication or source in accordance with accepted scholarly practice.
Attribution does not create endorsement, partnership, accreditation or authorisation beyond the limited permission provided by these Terms.
8. Permission for other uses
Commercial licensing, substantial reproduction, adaptation, translation, publication, partnership use and AaBC123-branded training require separate prior written permission.

Permission is granted only when confirmed in writing. A lack of response does not constitute permission.
9. Research, co-design and collaborative projects
These Terms do not determine ownership of intellectual property created through a separately agreed research, grant-funded, co-design or collaborative project.
Where a separate written agreement applies, that agreement governs the relevant project. Participation in a project or collaboration does not, by itself, transfer ownership of the pre-existing AaBC123 Framework™, Resources, branding or other background intellectual property.
10. Educational and wellbeing information
The Resources provide general educational and wellbeing information. They do not provide individual medical, psychological, legal or other professional advice and are not intended to diagnose, treat or manage a mental illness, medical condition or emergency.
Users remain responsible for exercising professional judgement, working within their qualifications and scope of practice, and seeking appropriately qualified assistance where required.
The Framework is not a substitute for clinical assessment, treatment, emergency support or professional advice tailored to an individual’s circumstances.
11. Accuracy and outcomes
We take reasonable care in developing and reviewing the Resources. However, wellbeing science and professional knowledge continue to evolve.
We do not guarantee that every Resource will remain complete, current or suitable for every person, population, setting or purpose. We do not guarantee any particular personal, educational, organisational or health outcome from using the Framework.
You are responsible for deciding whether and how the Resources are appropriate for your circumstances and context.
12. Australian Consumer Law and liability
Nothing in these Terms excludes, restricts or modifies any right, guarantee, condition or liability that cannot lawfully be excluded, including any applicable rights under the Australian Consumer Law.
To the maximum extent permitted by law, we are not responsible for indirect or consequential loss arising from reliance on, misuse of or inability to access the Resources.
13. Privacy and communications
Personal information collected through the resource-access form and mailing list will be handled in accordance with our Privacy Policy.
By separately agreeing to join the AaBC123 mailing list, you consent to receiving occasional AaBC123 research, resources and updates. You may unsubscribe using the link included in our communications.
Unsubscribing does not prevent you from continuing to use Resources already lawfully obtained, provided you continue to comply with these Terms. However, you may no longer receive updated or replacement versions.
14. Ending your permission
Your permission to use the Resources ends automatically if you materially breach these Terms.
If this occurs, you must stop using the Resources and delete or destroy copies in your possession or control, subject to any records you are legally required to retain.
We may also restrict future access where reasonably necessary to protect the Resources, intellectual property, users or integrity of the Framework.
15. Changes to these Terms
We may update these Terms when the Resources, access arrangements or applicable requirements change.
The current version and its last-updated date will be published on this website. Material changes will apply prospectively. We may ask you to accept updated Terms before accessing new or updated Resources.
16. General provisions
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to operate.
These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts having jurisdiction in Queensland and any courts entitled to hear appeals from them.
